1. Acceptance of Terms

By accessing or using ConsultNow ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

ConsultNow is a marketplace platform that connects clients with professional consultants for paid 1-on-1 consultation sessions. We provide the technology infrastructure to facilitate bookings, payments, and session management.

3. User Accounts

To use certain features of the Platform, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

You must verify your email address to complete registration. We reserve the right to suspend or terminate accounts that violate these terms.

4. Consultant Obligations

Consultants using the Platform agree to:

  • Provide accurate information about qualifications and expertise
  • Honor scheduled session bookings or provide timely cancellation
  • Deliver professional and competent consultation services
  • Maintain confidentiality of client information
  • Comply with all applicable laws and professional standards
  • Pay applicable subscription fees for their selected tier (BASIC, PRO, or PREMIUM)

5. Client Obligations

Clients using the Platform agree to:

  • Provide accurate booking information
  • Attend scheduled sessions on time
  • Pay for booked sessions as agreed
  • Treat consultants with respect and professionalism
  • Follow cancellation policies as described below

6. Payments and Fees

Session Payments

All session payments are processed securely through Stripe. Payment is required at the time of booking. Consultants receive 85% of session fees; ConsultNow retains 15% as a platform fee.

Subscription Fees

Consultants may subscribe to BASIC (free), PRO ($49/month), or PREMIUM ($199/month) tiers. Subscription fees are billed monthly or annually and renew automatically unless cancelled.

7. Cancellation and Refunds

Session Cancellations:

  • Cancellations made 24+ hours before the session: Full refund
  • Cancellations within 24 hours: Subject to consultant's individual policy
  • No-shows: No refund unless extenuating circumstances apply

Subscription Cancellations: You may cancel your subscription at any time. Access continues until the end of the current billing period.

8. AI Copilot Feature

PREMIUM subscribers have access to our AI Copilot feature, which assists with session notes, action items, and follow-ups. By using AI Copilot, you acknowledge that AI-generated content is provided as a tool to assist human decision-making and should not be solely relied upon. ConsultNow is not responsible for decisions made based on AI-generated insights.

9. Intellectual Property

The Platform, including its design, features, and content, is owned by ConsultNow and protected by intellectual property laws. You may not copy, modify, or distribute our platform or content without permission. Consultants retain ownership of their expertise and materials shared during sessions.

10. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

ConsultNow is a marketplace facilitator. We do not provide consulting services directly and are not responsible for the quality, accuracy, or outcomes of consultations between users.

11. Limitation of Liability

To the maximum extent permitted by law, ConsultNow shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amounts paid by you to ConsultNow in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless ConsultNow and its affiliates from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

13. Termination

We may suspend or terminate your account at our discretion if you violate these Terms or engage in harmful conduct. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination shall survive.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.

15. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or through the Platform. Your continued use after changes constitutes acceptance of the modified Terms.
